RECEIVED FROM________________________________________________________
Herein referred to as "Tenant", the amount of $_____________, evidenced by check/money order as a deposit which, upon acceptance of this Rental Agreement, shall belong to the Owner/Agent of the premises, and shall be applied to the due amount only, towards rent and security deposit.
Tenant hereby offers to rent from the Owner/Agent the premises situated in Manistee County; 14637 Pine Lake Road, Wellston MI 49689.
(1) TERM
: The term hereof shall commence on _____________ terminating on _____________ .

(2) RENT
: Tenant agrees that the rent shall be a total of $________ payable in advance, due one week before Rental Term to Owner/Agent, at the following address: Up North Getaway LLC, PO Box 1212, Walled Lake, MI 48390 - Phone: (248) 613-0700 or (248) 227-3585. Tenant further agrees to pay $50.00 for each dishonored bank check.

(3) Owner agrees and shall be responsible for the payment of any and all utilities.

(4) OCCUPANCY
: The premises shall be used as a cottage rental with no more than 12 people, and for no other purpose without the written consent of the Owner/Agent.

(5) PETS
: No pets shall be brought on the premises, either inside or outside without the written consent of the Owner/Agent.

(6) JOINT AND SEVERAL LIABILITY
: It is expressly understood that this Agreement is between the Owner/Agent and each signatory jointly and severally. In the event of default by any one signatory, each and every signatory shall be responsible for all provisions of this Agreement.

(7) APPLIANCES
: The premises are rented with appliances. The appliances on the premises include: Microwave Oven, Stove, Oven, and Refrigerator and are on the premises for the convenience of the Owner/Agent and Tenant. If any such appliances fails to operate, the Owner/Agent is required to repair the appliance or replace such appliance.

(8) ORDINANCES AND STATUTES
: Tenant shall comply with all statues, ordinances and requirements of all municipal, state and federal authorities now in force, or which may hereafter be in force, pertaining to the use of the premises.

(9) LIABILITY OF TENANT: Tenant shall be responsible for any personal injury or property damage caused by Tenants, agents, clerks, servants, invitees and visitors, and property damage caused by the overflow or escape of water, steam, gas or any other substance resulting from any intentional act of negligence of Tenant's agents, clerks, servants or Tenant's visitors. The Owner/Agent shall be released from liability arising from loss, damage, or injury to property of Tenant, invitees, and any other persons, caused by fire or other casualty for which insurance is carried by the Tenant, under a policy which permits waiver of liability and waives the insurer's rights of subordination, to the extent of any recovery by the injured party under the policy. The Owner/Agent shall be released from liability arising from loss, damage, or injury to Tenant, invitees, and any other persons, caused by the grounds not being kept, further, Tenant agrees to take caution and assume all liability of snow and/or ice removal during Tenants stay.  Tenant agrees that any judgment against Owner/Agent may only be enforced against this property.

(10) MAINTENANCE, REPAIRS OR ALTERATIONS
: Tenant shall not make any alterations to the property. All repairs and maintenance will be delegated/managed by Owner/Agent.  Owner has a snow removal service, but at times the grounds (decking, driveway, porch, etc...) may not be clear of snow and/or ice.  Tenant agrees to take caution and assume all liability of snow and/or ice removal during Tenants stay.  Owner provides a cleaning service to clean the inside of the cottage when Tenant's rental term is over.

(11) INSURANCE COVERAGE: Tenant acknowledges and agrees with Owner/Agent's fire, hazard, and liability coverage for injury or damage to persons or property, both real and personal, does not extend to or on behalf of the Tenant.

(12) ATTORNEY FEES: :  In the event any legal action is brought by either party to enforce the terms herein or relating to the demised premises, the Owner/Agent shall be entitled to all costs and attorney fees incurred in connection with such action, unless ruled otherwise by the Court.  If any one or more clauses contained herein shall be declared invalid or unenforceable in the future the remainder hereof shall stand as valid and enforceable.

(13) SECURITY DEPOSIT:  Owner/Agent acknowledges receipt of $350.00 as a security deposit for the performance by the Tenant of the terms of the Agreement. Owner/Agent may use the security deposit for the following purposes in accordance with the Security Deposit Act: Reimburse the Owner/Agent for actual damages to the rental unit or an ancillary facility that are the direct result of intentional or negligent conduct of Tenant (see Liability of Tenant above). The appropriation of all or part of this security deposit shall not be the Owner/Agent's exclusive, but shall be cumulative, in addition to any other remedies to which this Agreement, at the expiration of the term hereof, the security deposit shall be returned to the Resident/Tenant within fifteen (15) days after the premises have been vacated and inspected by the Owner/Agent. No interest shall accrue to Tenant on any such deposit and the Owner/Agent may commingle the security deposit with any other security deposit paid Tenant to Owner/Agent's. Tenant's security deposit is held by National City Bank.

(14) ADDITIONAL TERMS AND CONDITIONS:
There are two (2) working smoke detectors within the premises. 
The cottage is not 'child-proofed'.
